Anyone know of an appeals process for NYS CPA Applications? HELP =[

    I’m about to have a heart attack.

    So I worked for a private company doing books, taxes, and payroll. I was supervised daily by a CPA that was not employed directly in the firm but was hired as a contractor to supervise my time there until I could get up to speed.

    The CPA filled out the 4B and submitted it in. The state board rejected it based on the following:

    Paragraph A Subsection 4:

    Such experience shall be attested to by a certified public accountant licensed in New York or in another political subdivision of the United States or by a public accountant licensed in New York, provided that such certified public accountant or public accountant acted in a supervisory capacity to the applicant in the employing organization.

    I interepreted that as a supervisory capacity to the APPLICANT (who is) in the employing organization.

    It does not explicitly state that the supervising CPA needs to be in the employing organization.

    This is a technicality and because of this I am missing 91 days of experience. I’m trying to appeal this but I don’t know what to do. My heart sunk into the floor.

    Does anyone know if an appeals process exists? Anyone I can speak to regarding this? I’m absolutlely bummed out right now.

    Are you no longer working? Is that what prevents you from reapplying later?

    Sorry for the confusion.

    I have more than the year's worth of experience. 274 days with CPA A and 1 year with CPA B.

    The 274 days was approved with CPA A for a company I no longer work for.

    The 1 year was rejected per the above with CPA B also for a company I no longer work for.

    Therefore, I am short 91 days because they rejected CPA B's 4B.

    Currently, I do not work under a CPA nor is there one here that can certify my time. I'd have to quit my current job and find a job where there is a CPA who would be my supervisor.

    AUD - PASSED!!!!

    Sounds like you'll need to find a job where you will have a CPA be your supervisor.

    What I am trying to accomplish is to have the rejection of CPA B's 4B overturned on the technicality that a prudent person could interpret that provision as:

    “A NY supervising CPA certifies the time of an applicant in the employed organization listed on the 4B.”

    Otherwise why have a section for the CPA's firm/organization and one for the applicants employed company. It makes no sense.

    @nyczducky, I am also a NY candidate. NY is notoriously strict with the work experience requirements. Once the make a decision it is final.

    A have known a couple of people that had a situation similar to yours, i.e. they fell short of their work experience requirement by a small margin (a few weeks). The only solution is to secure part time work with a small CPA or sole practitioner. NY counts part time work of 20 hours/week. You will be given half time for this.

    This is the only way around your issue. Sorry to hear…

    @bigfourexpert That doesn't help. Would you quit your job where you are making good money and are set to be promoted and work for someone else when you already did the time? Didn't think so.

    I'm not telling you to not appeal, but I doubt this is the first time they have had this issue come up. A prudent person could also interpret that statement to mean that you are being supervised by someone who works for the same company as you do, not some freelance who has no stake in your employer. Your interpretation could basically open up for anyone with a CPA to supervise anyone, just because they're in the same physical location everyday for the same amount of time.

    I feel for you, but you'll probably lose the appeal.

    Lol, I didn't tell you to quit your job, just that you're probably not getting your CPA until you do.

    That sucks.

    I think NJ and/or PA are that way too- the certifying CPA and the applicant need to have a common employer.

    You could always try to do some weekend busy season work at a small shop or sole practitioner. It may take you a couple years, but you'll get there that way and you can stay employed where you are.

    Not to mention that form usually says something like “to be submitted by your employer” in which this case that did not happen.

    Do you have any evidence that places both of you there during the time frame in question?
