Corporate capital gain tax rate

    On the Becker, it says corporations do not get the benefit of lower capital gains rates. It also say section 1231 gains are entitled to capital gain treatment. That just make me so confused. So does Corporate’s 1231 gain get lower tax rate?

    Corps dont get pref treatment on cap gains but 1231 losses can be used against ordinary income

    Corporations long term and short term capital gains are taxed at ordinary income rates.

    However they DO get the capital gain rate on 1231 gains. Darcer is correct about the 1231 ordinary losses. I just took REG today. Hopefully I did enough to pass because I really do not want to study this again!

    Correct. I verified this in my Becker book to make sure. Corporations do not get the benefit of lower capital gains rates, unless the gain is Sec 1231. If you have the Becker book, it is on page R4-29.
