OT: How to protect my license

    I am currently seeking a new job, this is not likely to be a long time situation but I can not be unemployed.

    I do not SERIOUSLY believe my cpa license would be in jeopardy but not taking any chances.

    My boss wants to give all of the employees gift cards as awards/bonus. I told him that the IRS is clear that gift cards (of ANY value, even $10) must be added to the employee’s taxable income. He (not a CPA) demanded that I give out the gift cards and not add them to ADP.

    I asked him to please put that order in writing, as I have a CPA license to protect and will not jeopardize it over a stupid $50 amex gift card. He has refused. In fact he raised his voice and told me he will NOT let me hold MY CPA license over HIS head.

    Again, even if the IRS caught this minimal infringement, HE would be responsible for the penalties and fines if any. I don’t sign off on any of this. Just fries my backside that he would HIRE a CPA and not take the advice of the professional he chose.

    Off to search monster.com………….again.

    Wow, what a jerk!!!!! I honestly don't know what to tell you, but scenarios like this one frighten me as well….

    Let me see what I recall from our REG exam/ethics……..if you discover an error in a previous tax return, you advice them to correct it, and if they refuse, you should reconsider working for them in the future….so, if you apply this in your current scenario, I guess you have no choice but follow your boss's orders and look for a new job – just like you are doing already!

    Just add the gift cards to ADP and in the future don't tell your boss every little thing that you need to do to do your job properly. If he fires you as a result you may have cause for legal action. It is lame though that the IRS requires employers to include $50 dollar gift cards in compensation. I guess materiality doesn't come into play with issues in tax.

    Trust me I don't tell my boss much of anything I do. BUT when it comes to making an adjustment on every employee's W-2 form its no longer a little thing., Many employees will check their W-2 to their final paystub of the year. Many of them will come to HR and/or accounting if it is different.

    A company needs to have a written policy about such things (which is why most companies don't give out gift cards ever).

    This one “little thing” is really not so little. You don't screw with people's taxable income without giving them a heads up first and have it very well documented.

    I've been working a long long long time LOL. I know when it needs to be discussed and when it doesn't.

    There is a phrase that I can teach you to deal with this kind of stupidity on your employers part. It starts with an F and ends with a you! No body puts my license in jeopardy and I commit tax fraud for no one!!!
