Personal Holding Companies – Family Rules

    Hi, just have a question pertaining to who qualifies as family for the PHC tests. This is the test to see if individuals own directly or constructively a certain portion of a Corporation.

    I know the following are considered family:

    Spouse

    Partner (if in business partnership)

    Ancestors

    Descendants

    Siblings

    What about Ancestors of your spouse? IE Father-in-Law?

    Or Spouse of your descendant? IE Son-in-Law?

    I couldn’t find anything that specifically mentioned in-laws, so I assume that they did not count as family.

    I have in my notes that in laws are not considered family, but you may want to see what other people say just to be sure.
