CPA Ability to File Returns

    Hello,

    I am a CP registered in NY living in Colorado. I am currently under review for Colorado reciprocity. I am pretty sure that under C.R.S 12-2-101 and 3 CCR 705-1 I cannot prepare tax returns for any Colorado clients. Is this accurate or am I missing something.

    How about potential New York clients? I would imagine that I would be able to prepare returns for them.

    I would appreciate any insight into these questions. I would really like to get started filing returns, however I want to make sure that I am following all of the rules

    I was not aware of any licensing requirement to file/prepare tax returns. I thought that the PTIN is all you need. Most tax preparers are not CPAs.

    Correct ^ I believe you can still file returns, you just cannot use the title “CPA” or advertise that you're a CPA in that state.

    Can I advertise that I am a New York CPA or not at all? What about for clients in New York?

    I believe you can advertise like “Lexus423, CPA (NY)”. I'm no law expert, so I'd look into it further.

    There are no CPA requirements to file returns. You need a PTIN number and if you want to file electronically, you need an EFIN number from the IRS. THe EFIN application process takes some time, so you are late if you don’t have it by November for the following year.
