Spain Tax Law for AirBnB

    Hello everyone,

    I am visiting Spain in a couple months and my friend who booked an AirBnB apartment received an email from the host asking for the guests’ passport information ahead of time

    Aside for security purposes for the host, apparently there is a Spanish tax law that mandates the hosts to collect the guests’ passport information. Failure to do so will result in a heavy fine according to the law. This also occurs in other European countries such as Portugal, Germany, etc. I’m aware this practice is followed by hotels.

    Can someone please provide a credible governmental link or source (not an AirBnB or Reddit forum) that mentions about hosts collecting passport information?

    Found this on airbnb, but it is not a forum post it is an actual article from the company regarding the verification. It does not sound like this information should be going directly to the host.

    ii. Registration Form

    • All lodgers, not just the one making the reservation, will be fully identified in compliance with current Security laws (popularly dubbed as ‘Gag’ Law). Lodgers will supply a copy of their personal ID/passport. Like in hotels, all guests will be required to fill in and sign a registration form on entry. In compliance with art 7.2 this registration form must be then sent to the Police or Guardia Civil for every guest over the age of 16 years old within the next 24 hours of the accommodation following Security Laws from 2003 (Orden INT/1922/2003, de 3 de julio, sobre libros-registro) and from 2015. You can send a copy of the filled in and signed registration form personally, by fax or else by e-mail. Registration forms are standardized by law; click here for a sample copy.

    Just looking at it quickly and there is no way for me to verify the article's authenticity. It looks like you sign in, fill out the form and supply a copy of your passport. Though I don't see any reason for you to send the information ahead of time before meeting the potential host.
