Speeding Ticket Help!

    This is very random but… I got a speeding ticket last night (a speed trap at the bottom of a large hill) and it’s the 2nd one in 6 months (the other was on a highway which isn’t considered a highway so the speedlimit was 55). Both are very much my fault, but at the same time are frustrating considering both were past 10:00pm with absolutely no one around. Had they been at 7am going the same speeds, no one would be pulled over.

    I’m doing online supervision for the first one but you can’t do it twice in 12 months. These are the only tickets I’ve ever gotten. What do I do? Also, I’m 23.

    The fact that you've posted two scores tells me that you're aware this is a site for future CPAs (and some current CPAs).

    Other than that, I have no idea why you're asking the question on here (as you stated…random). You got a ticket. Pay it and move on.

    If by some chance you're thinking of these tickets as black marks on your record that could hamper your ability to get licensed, it should be noted that simple speeding is not an actual crime, but is considered an infraction. Again, not sure if that is your concern or not. State laws vary, of course, but unless you were speeding by so much that it is considered reckless driving or the like, you should be fine.

    Let us know more specifically why you're asking the question on this forum please.

    I'm asking here because I trust the community and thought people may have some life-experience that could be helpful. I'm aware it's completely outside the realm of what this forum is for, that's why it's in the “Other Topics” section 😉

    Gotcha.

    My advice would be to be more careful in the future and pay the ticket soon if you haven't already done so. The fact that it was a “speed trap” means nothing.

    My life experience – slow down, it's not worth speeding. I got a lot of tickets in my 20s and the fact is you really don't save that much time by speeding. And, yes, especially late at night you're more likely to be pulled over so go even slower then. My rule of thumb is about 5mph over the speed limit is pretty safe. But you need to be aware what the speed limit is. Usually when you pass through a more urban or busy area the speed limit will drop. As a note, in a lot of parts of the country (such as New England) 55 is a typical highway speed.

    I guess my question is this – I've already done the traffic school online and you can't do it twice in 12 months. Do I have to go to court with a lawyer and hope for the best or is there an alternative?

    Paying the speeding ticket will usually cause your insurance to go up. Either try to get a lawyer to keep moving the court date and get it dismissed that way or ask the court for “deferred adjudication”, which basically puts you on probation for 6 months and the ticket gets dismissed assuming you dont get another one in those 6 months.

    @emerged, since it was your fault, you do not need a lawyer to help you fight it. Just pay your ticket and it should drop off your record in 2-3 years.

    @kahloon how do you ask for “deferred adjudication”? This seems like the most simple way. I definitely don't want to pay and have insurance go up

    If you want to spend time with deferred adjudication and the like you will end up doing exactly that: spending time!

    Your time might be better spent studying for the CPA exam. You honestly don't need other things distracting you. I'm literally twice your age and I can tell you that the big picture is just that….the big picture. You're spending energy you don't have worrying about insurance rates and deferred adjudication. Pay it and get back to studying.

    Is it true that the first speeding ticket doesn't increase insurance rates? And what counts as the “first speeding ticket”, either the literal first or first officially on record?

    dude pay your fine and slow down. Going to court for the 2nd violation is just silly. You should spend this time studying for FAR and REG and stop with the going to court nonsense. Speeding is a very black and white situation. The time of day is irrelevant. If you were speeding you have no case, and wasting time and resources on going to court or other means of trying to fight it is just plain silly.

    You are spending way to much brain power on this.

    Slow down, pay the ticket, learn and move on. If you go to court they will see you just got one you did a class on and obviously know you haven't learned anything from it. It will be a shot in the dark and waste of time, effort, and resources. This is coming from someone that has been in your situation. You will learn eventually. The only way to learn is to suffer a little in the interim.

    I agree with the rest of the people in here. A lawyer is going to cost you a lot more than the ticket, and the outcome will most likely be the same. Pay the 200 bucks or whatever, and move on. In my experience, insurance doesn't change too much for a speeding ticket.

    Here is my take. I spent six years as a police officer prior to becoming a CPA. Speeding tickets are extremely difficult to fight in court, especially since you admit you are at fault. I wrote many speeding tickets, I never lost one at trial. Also, don't waste money on an attorney for a speeding ticket. They are going to charge you about 10 times what the cost of paying the fine would be and if you lose you will pay both the attorney and the fine.

    Pay the fine. Slow down. Move on.
