OT: How to protect my license - Page 2

    I am currently seeking a new job, this is not likely to be a long time situation but I can not be unemployed.

    I do not SERIOUSLY believe my cpa license would be in jeopardy but not taking any chances.

    My boss wants to give all of the employees gift cards as awards/bonus. I told him that the IRS is clear that gift cards (of ANY value, even $10) must be added to the employee’s taxable income. He (not a CPA) demanded that I give out the gift cards and not add them to ADP.

    I asked him to please put that order in writing, as I have a CPA license to protect and will not jeopardize it over a stupid $50 amex gift card. He has refused. In fact he raised his voice and told me he will NOT let me hold MY CPA license over HIS head.

    Again, even if the IRS caught this minimal infringement, HE would be responsible for the penalties and fines if any. I don’t sign off on any of this. Just fries my backside that he would HIRE a CPA and not take the advice of the professional he chose.

    Off to search monster.com………….again.

    There is a phrase that I can teach you to deal with this kind of stupidity on your employers part. It starts with an F and ends with a you! No body puts my license in jeopardy and I commit tax fraud for no one!!!

    Tell your boss if he wants to be nice and give giftcards, so gross up the employees check and pay the tax on the giftcards as well

    Wait, if he doesn't want you to enter the gift cards expense in ADP, how would you record a journal entry?? CR to cash, and DR to what??? Thin air??? Or maybe he is cashing it out if he is a partner as a distribution, in which case he can give it away as a gift to you, and he will be taxed on the amount he took out??

    acamp, that is the RIGHT way to do it!! (actually the best thing is to tell the recipients to choose a gift and we will purchase it for them, how hard is that?)

    Kricket, yeah, I'm hoping one of these interviews will pan out and I'll get to use that phrase soon.

    Kitty, credit to cash and debit to misc expense. I kid you not. He hasn't a clue about anything accounting.

    we've been on a conference call with the attorney of an employee that he fired after I told him he couldn't DO that. You can't just fire someone because they're out on medical leave without a definite return date. duh. She got an attorney and is suing the company.

    You'd think with THAT looming over his pea brain, he'd; be a bit more receptive to my input. Go figure.

    Ugh, I am so sorry to read this. If I were in your shoes, I would write yourself an email or memo with the date to document everything (including what he said). If this ever comes back to bite you, you can show that you documented it and that he ignored your request to make this right.

    I hope your job search goes well. I have been searching since last June to get out the shady operations at my job so I feel your pain.     Ugh, I am so sorry to read this. If I were in your shoes, I would write yourself an email or memo with the date to document everything (including what he said). If this ever comes back to bite you, you can show that you documented it and that he ignored your request to make this right.

    Ugh Auslaf, I'm so sorry you can relate. My boss wants me to pull back revenue for December shipments so he doesn't have to pay taxes on them in 2013, which I have refused to do. I've also offered to conference call the auditors to discuss that LOL.

    He actually asked how we can have $1m in income for the purposes of determining his bonus but only $750 for taxes.

    I explained that it would be better for him just to give himself whatever bonus he wants (hey its a sole proprietorship) but do the tax side right. Also offered to conference call the CPA that does his taxes. He declined 😉

    One thing you might want to do, that would probably carry more weight in court should it ever come to it, is to download an app for your phone to record your conversations with him. I don't know about Massachusetts, but in Louisiana only one party has to have knowledge of the recording for it to be admissible in court.
